These Terms of Service (“Terms”) govern your use of Hummingbird Care Link (“we,” “our,” or “the Platform”). By accessing or using the Platform as a Care Seeker or Provider, you agree to these Terms.

1. Eligibility

• You must be 18 years or older to register as a Care Seeker or Provider.

• Providers must be licensed or registered to offer healthcare services in their jurisdiction.

• By using the Platform, you represent that all information you provide is accurate and up to date.

2. Platform Use

• The Platform is designed to connect Care Seekers with Providers for informational, consultation, and service purposes.

• Care Seekers may search, browse, and contact providers.

• Providers may create and maintain a company profile, set filters, and manage inquiries.

• The Platform is not a substitute for medical advice, diagnosis, or treatment. Providers and Care Seekers are responsible for all interactions.

• Users may not use the Platform for illegal purposes, spam, harassment, or data scraping.

3. Membership & Payments (Providers)

• Providers must register and maintain an active membership to display their company profile.

• Membership fees are governed by the Provider Membership & Pricing Policy.

• Memberships are billed monthly via Stripe. Providers retain access for any prepaid month after cancellation.

• Membership is required for full profile access, search visibility, and analytics.

4.  Content & Responsibility

• Providers are responsible for all content they post (company profile, filters, articles, etc.).

• Providers must accurately represent services, pricing, and qualifications.

• Care Seekers must provide honest information when submitting inquiries or using the platform.

• We reserve the right to remove any content that violates our policies or is deemed inappropriate.

5. Privacy & Data

• Use of the Platform is governed by our Privacy Policy.

• Users consent to our collection, storage, and use of information as outlined in the Privacy Policy.

• We do not share personal data with third-party advertisers.

6. Limitation of Liability

• The Platform acts as a matching service only; we do not provide healthcare, diagnose, or deliver services.

• Providers and Care Seekers are solely responsible for all interactions and transactions.

• Hummingbird Care Link is not liable for any damages, claims, or disputes arising from the use of the Platform.

7. Indemnification

You agree to indemnify and hold harmless Hummingbird Care Link, its affiliates, and employees from any claim, demand, or damage, including reasonable legal fees, arising from your use of the Platform, violation of these Terms, or violation of any applicable law.

8. Termination

• We may suspend or terminate your account for violation of these Terms or for illegal, harmful, or abusive behavior.

• Providers may cancel their membership according to the Provider Membership & Pricing Policy.

• Termination does not relieve you of obligations incurred prior to termination.

9. Changes to Terms

• We may update these Terms at any time.

• Continued use of the Platform after updates constitutes acceptance of the revised Terms.

10. Governing Law

• These Terms are governed by the laws of Canada.

• Any disputes shall be resolved in the courts of the province in which Hummingbird Care Link operates, unless otherwise agreed.
